Petitioner, already in custody, seeks bail in connection with Sahkund (Sajour) P.S. Case No.263 of 2017, registered under Sections 379, 411 and 188/34 of the Indian Penal Code, 40 of B.M.C.C. Rule, 1972 as well as under Sections 6/8 of Illegal Mining Transporting and Storage Act, 2003.

Allegation in brief is that the petitioner along with others is doing illegal mining and they were carrying sand on the tractor and apprehended by the police.

Learned counsel for the petitioner submits that nothing is recovered from possession of the petitioner, the petitioner has no criminal antecedent and the driver of the tractor and others have been admitted to bail by a coordinate Bench of this Court by

Patna High Court Cr.Misc. No.6943 of 2018(2) dt.06-02-2018 2/2 orders dated 11.01.2018 and 12.01.2018, passed in Cr. Misc. No.866 of 2018 and Cr. Misc. No.182 of 2018 respectively and the petitioner has no criminal antecedent.

Having considered the said facts and circumstances, petitioner Deepak Kumar Mandal is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Bhagalpur in connection with Sahkund (Sajour) P.S. Case No.263 of 2017.
