JUSTICE VINOD KUMAR SINHA ORAL ORDER 28-08-2019 Petitioner seeks bail in anticipation of his arrest in connection with Hilsa P.S. Case No. 48 of 2019 registered for the offence punishable under Section 7 of Essential Commodities Act.
Petitioner is PDS dealer and allegation against him is that he was supplying less quantity of rice and wheat to the consumers and he sold kerosene oil on higher price and on physical verification the allegation is found to be true. Submission of learned counsel for the petitioner is that impugned order disclosed that during investigation no such evidence has come and the matter is still under investigation. Further submission is that licence of the petitioner has been cancelled and he is ready to face the inquiry and also ready to

In view of above facts and circumstances, let petitioner surrender in the court below within a period of two weeks from the receipt of this order and on surrender he shall be released on bail by the court below itself on the condition that he has to co-operate in the investigation and appear before the Investigating Officer as and when required.
