The petitioner seeks bail in connection with Madhubani Town P.S. Case No.352 of 2015 registered under Section 414 of the Indian Penal Code.

The accusation is of recovery of the parts of the motorcycle and other materials, which are said to be stolen, from the 'Kabari' shop of the petitioner in course of raid by the informant.

Learned counsel appearing on behalf of the petitioner submits that, in fact, the petitioner is the owner of the 'Kabari, shop and has falsely been implicated in this case. Moreover, no

Patna High Court Cr.Misc. No.48097 of 2015 (2) dt.30-10-2015 2/2 person has claimed the articles alleged to be recovered from the shop of the petitioner. The petitioner having no criminal antecedent is in custody since 28.07.2015.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Madhubani, in connection with Madhubani Town P.S. Case No.352 of 2015/G.R. No.2239 of 2015.
