The petitioner seeks bail in connection with Tajpur P.S. Case No. 336 of 2018 dated 22.09.2018 instituted for the offence under Section 354B of the Indian Penal Code and Section 12 of the Protection of Children from Sexual Offence Act, 2012.

It has been alleged in the FIR that the daughter of the informant was attempted to be molested while she had gone to attend the call of nature. The tenor of the allegation in the FIR and the fact that after about 5 days of the occurrence, the case has been reported, make the prosecution version appears to be highly suspicious. There is no eye witness to the occurrence and there is a reason for falsely implicating the petitioner.

Patna High Court CR. MISC. No.48015 of 2019(3) dt.25-09-2019 2/2 It has been urged that both, the petitioner and the father of the victim, had contested elections at the local level and this case is a fall out of the enmity generated during the elections.

The petitioner is stated to be 65 years of age and is in custody since 07.06.2019.

Considering the aforesaid facts, the petitioner above named is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Ist Additional District and Sessions Judge, Samastipur in connection with Tajpur P.S. Case No. 336 of 2018.
