Petitioner seeks bail in a case registered for the offences punishable under sections 302 of the Indian Penal Code and section 27 of the Arms Act.

Petitioner is not named in the F.I.R. During the course of investigation, witnesses disclosed that petitioner was seen going by the motor cycle along with Vikash Mishra. Petitioner was driving the motor cycle and Vikas Mishra was the pillion rider. They were seen just after the occurrence. It is submitted that except suspicion there appears to be no tangible material against the petitioner. Similarly situated co-accused Vikash Mishra has already been enlarged on bail. Case of the petitioner stands on the same footing.

Patna High Court Cr.Misc. No.45489 of 2015 (2) dt.30-09-2015 Considering the facts aforesaid, petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sitamarhi in connection with Belsand P.S. Case No. 72 of 2014.
