The petitioner is in custody since 09.07.2015 in connection with Nardiganj P.S. Case No. 73 of 2015, registered for offences punishable under Sections 399/402 of the Indian Penal Code and 25(1-b) A/26/35 of the Arms Act. Learned counsel for the petitioner submits that though, there is an allegation that a country made pistol has been recovered from the possession of the petitioner, actually no such recovery has been made from the conscious possession of the petitioner.

Considering the aforementioned facts and circumstances, the period of custody and also that the petitioner has no criminal
