JUSTICE ARUN KUMAR ORAL ORDER 19-01-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Mithanpura PS Case No. 341 of 2017 registered under Sections 392 of the IPC and Section 27 of the Arms Act.

The allegation in brief against the petitioner is that is that on the confessional statement of his one of the sons that 50,000/- rupees out of looted money he had given to his father (the petitioner) for monthly expense and thereafter recovery of 45,000/- rupees was made.

Learned Counsel for the petitioner submits that the petitioner just prior to the said recovery had withdrawn 50,000/- rupees from the account of his Bank and that money was recovered. There is bank statement of the withdrawal by the petitioner from his account. The petitioner is 62 years old man having clean antecedent, his one of the sons and daughter-in-law both are primary school teachers. Having considered the said facts and circumstances, the petitioner, namely, Shatrughan Prasad Singh is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of SdJM (East) Muzaffarpur in connection with Mithanpura PS Case No. 341 of 2017.
