In this case, the petitioners are apprehending their arrest in connection with Mojahidpur (Babarganj) P.S. Case No. 67 of 2019 registered for offences under sections 341, 323, 308, 504, 506/34 of the Indian Penal Code.

In the present case, an allegation has been made against the petitioners of assaulting the Informant and her brothers by lathi and the butt of the rifle.

The petitioners have been granted police bail under Section 41 of the Cr.P.C.

In view of the judgment passed by this Court in the

Patna High Court CR. MISC. No.47065 of 2019(2) dt.30-07-2019 2/2 case of Mahendra Prasad Singh Vs. The State of Bihar reported in 2004 (3) PLJR 491, if the petitioners surrender and if they have not violated the terms and conditions of the trial, the court below, without being prejudiced by this order, will take a decision in accordance with law.
