JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 29-09-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is not named in the first information report but in course of investigation, one co- accused Bhim Yadav was apprehended and the aforesaid co-accused made his confessional statement leading to recovery of dead body of the deceased. The name of petitioner and two others came in confessional statement of co-accused. Apart from this, the tower location of mobile of the petitioner was also found in the vicinity of the place of occurrence and it is stated that the petitioner was the main conspirator of the murder of the deceased.
Learned counsel for the petitioner points out that Satish Kumar Yadav @ Suman Kumar @ Sukhari Yadav and
Patna High Court Cr.Misc. No.45205 of 2015 (2) dt.29-09-2015 2/2 Ramdeo Yadav have already been granted privilege of bail by a co-ordinate Bench of this Court and the case of the petitioner is on similar footing to those accused persons who have been released on bail.
Considering the aforesaid facts and circumstances as well as submissions of the parties and also taking note of this fact that petitioner does not have any criminal antecedent, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of 4th Additional District and Sessions Judge, Jamui in connection with session trial no. 177 of 2014 arising out of Mallhpur ( Jamui) P.S.Case No. 29 of 2013.
