JUSTICE PRAKASH CHANDRA JAISWAL ORAL ORDER 17-01-2018 Heard learned counsel for the petitioner and learned APP for the State.

The petitioner seeks bail in Warisnagar P.S. Case No.221 of 2017 registered under Section 25 (1-b)A/26/35 of the Arms Act.

As per the prosecution case, one country made pistol is said to have been recovered from the possession of the petitioner.

It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from his conscious physical possession. As a matter of fact, the petitioner happens to be vendor of a Sudha Milk Parlor and while he was going to fetch the milk from the depot for his parlor he was arrested and falsely roped in this case by planting arms. Without any cartridge the arms is useless. He has no criminal antecedent.

Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Samastipur in connection with Warishnagar P.S. Case No.221 of 2017.
