SONI SHRIVASTAVA ORAL ORDER 29-04-2025 Heard learned counsel for the petitioner, learned counsel for the opposite party no.2 and learned APP for the State.

2. The petitioner apprehends his arrest in connection with Complaint Case No.2312 of 2014 for the offences punishable under Section 498A of the Indian Penal Code and Section 3⁄4 of the Dowry Prohibition Act.

3. The petitioner is the husband of opposite party no.2 and there is allegation of demand of dowry and torture.

4. It is submitted by learned counsel for the petitioner that the allegations made in the complaint are totally false. As a matter of fact, the petitioner is ready to keep the complainant in

It is further submitted that the petitioner is suffering from cancer and he is under regular treatment under the Mahavir Cancer Sansthan, Phulwarisharif, Patna. The medical certificate and reports are also annexed along with this petition as Annexure-P/2.

5. Learned APP for the State opposed the prayer for anticipatory bail.

6. Considering the facts and circumstances of the case as also the fact that the petitioner is suffering from cancer, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending/successor Court in connection with T.R. No.770 of 2024 arising out of Complaint Case No. 2312 of 2014, subject to the condition as laid down under Section 438

(2) of the Cr.P.C.
