Petitioner, already in custody, seeks bail in connection with K. Nagar P.S. Case No. 483 of 2017, registered under Sections 392 and 411 of the Indian Penal Code. Learned counsel for the petitioner submits that the First Information Report is lodged against unknown and there is no recovery of any article, cash or the mobile. It has further been submitted that the petitioner was apprehended merely on suspicion as there was a talk with one of the looted mobile from his SIM Card and, in fact, the petitioner has a repairing shop of mobile phone and the said mobile phone was given by one of the customers for its repairing and the petitioner just checked it by
Patna High Court Cr.Misc. No.4328 of 2018 (2) dt.01-02-2018 2/2 inserting his SIM Card. It has also been submitted on behalf of the petitioner that the petitioner, who is in custody since 24.09.2017, has clean antecedent and charge-sheet has also been submitted in this case.
Having considered the said facts and circumstances, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea, in connection with K. Nagar P.S. Case No. 483 of 2017.
