JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 2 16-09-2015 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner has renewed his prayer for bail in connection with Industrial Area P. S. Case No. 80 of 2014 registered under Sections 307, 386, 387 of the Indian Penal Code and Section 25(1-B)(a) and 27 of the Arms Act. The prayer for bail of the petitioner was earlier rejected by this Court vide order dated 01.12.2014 passed in Cr. Misc. No. 41881 of 2014 with following observation:- "In case the trial of the case is not concluded within nine months from the date of

Patna High Court Cr.Misc. No.43112 of 2015 (2) dt.16-09-2015 2 / 2 receipt/production of a copy of the order, the petitioner would be at liberty to renew his prayer for bail."

It is contended that though the petitioner is in custody since 19.06.2014, the charges have not been framed till date.

Regard being had to the facts and circumstances of the case, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 1st Assistant Sessions Judge, Vaishali at Hajipur in connection with Sessions Trial No. 74 of 2015 arising out of Industrial Area P.S. Case No. 80 of 2014.
