Heard learned counsel for the petitioner. He has submitted that during pendency of this petition the Title Suit No. 427 of 2018 has already been disposed of. As such, this petition has become infructuous.

The learned counsel for the petitioner has made a prayer to dismiss the miscellaneous petition as withdrawn with a prayer to grant liberty to raise the points involved here at the appellate stage.

Accordingly, the petition is being disposed of. Office shall ensure that all defects are removed by the petitioner within the stipulated time provided in para-1 hereinabove, failing which the matter shall be brought to the notice of this Court.
