2. The petitioner seeks bail in connection with Sherghati P.S. Case No. 471 of 2021 registered for the offence under Sections 379 and 420 of the I.P.C.
3. The petitioner is named in the F.I.R. and is in custody since 18.05.2024.
4. The allegation against the petitioner is to commit fraud upon informant, who was the account holder with CSP Branch of SBI where petitioner was the employee of co-accused Balkishor Pathak.
5. Learned counsel appearing on behalf of the petitioner submitted that the thrust of allegation is

No.48933 of 2025(2) dt.10-09-2025 2/3 available against named co-accused Balkishor Pathak who is the owner of CSP, and already granted bail by one of the learned Co-ordinate Bench of this Court through Cr. Misc. No. 43927 of 2025 dated 06.08.2025, where he undertake to deposit Rs. 1 lakh as found transferred from the account of the informant. It is submitted that petitioner was the employee of co-accused Balkishor Pathak and he transferred Rs. 40,000/- to his account on his instructions and therefore, he is not under any liability. While concluding the argument, it is submitted that petitioner is a man of clean antecedent and moreover, investigation of this case is completed, for which charge-sheet has been submitted, as such, there is no chance of tampering with the evidence.
6. Learned APP duly assisted by learned counsel for the informant while opposing the prayer of bail submitted that petitioner actively participated in alleged illegal transfer of money from the account of the informant, however, he could not disputed the factual

In view of aforesaid factual submission and by taking note of nature of accusation, coupled with fact that investigation of this case already completed where petitioner remains in custody since 18.05.2024, accordingly petitioner above named, is directed to be released on bail in connection with Sherghati P.S. Case No. 471 of 2021 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-I, Sherghati, Gaya /concerned court, subject to the conditions as mentioned under Section 437(3) of the Cr.P.C/ Section 480(3) of BNSS.
