JUSTICE SANDEEP KUMAR ORAL ORDER 10-01-2025 Heard the learned senior counsel for the petitioner, learned APP for the State; Sri Jharkhandi Upadhyay and the SHO-cum-I.O. of Shastrinagar Police Station; Sri Amar Kumar.

2. The petitioner, who is in jail since 01.04.2024, seeks regular bail in connection with Shastrinagar P.S. Case No. 219 of 2024 registered for the offence under Sections 307, 326/34 of the Indian Penal Code and under Section 27 of the Arms Act. Section 302 of the Indian Penal Code was added subsequently.

3. As per the prosecution case, criminals demanded extortion, fired at the vegetable sellers in the town of Patna at Punaichak. Three persons sustained injury out of whom one died.

4. During investigation, it has come that the crime was committed at the behest of Chotu Gope and Santosh Gope. The name of this petitioner and his son has come in the selfinculpatory statement of one Chotu Kumar @ Chotu Gope.

5. Considering the fact that it is a case of murder for demand of extortion and the petitioner has been found involved in the same i.e. the accused persons were operating as a gang, I am not inclined to grant bail to the petitioner.

7. Accordingly, this application for regular bail is dismissed.

8. The court below is directed to expedite the trial of the petitioner.

9. The personal appearance of the SHO of Shastrinagar Police Station is dispensed with. (Sandeep Kumar, J) Shishir/- U T
