JUSTICE ARUN KUMAR ORAL ORDER 07-03-2018 Heard learned counsel for the petitioners, learned counsel for the informant and learned A.P.P. for the State. Petitioners, already in custody, seek bail in connection with Yogapatti P.S.Case No. 346 of 2017, registered under Sections 147, 148, 149, 452, 341, 323, 324, 302 and 506 of the Indian Penal Code.
Allegation in brief is that informant's son was assaulted and killed by the accused persons in the mid night in their house for the reason that the accused Naryan Rai's daughter, Rinki Kumari had eloped with the deceased earlier. Learned counsel for the petitioners submits that there is allegation against thirteen persons that they assaulted the

No.3413 of 2018 (3) dt.07-03-2018 2/2 deceased but the injury is only four, out of which three injuries are swelling and abrasion on left arms, right arms and one lacerated wound on the head, caused by hard and blunt substance as per the Post mortem report. It is further submitted that the deceased had entered into the house of the informant and therefore, he was assaulted.
Learned counsel appearing on behalf of the State submits that the dead body of the deceased was found in the house of the accused persons and they assaulted the deceased. Having considered the nature of offence and recovery of the dead body of the deceased from the house of the petitioners, their prayer for bail is rejected.
The petitioners are in jail custody since 17.09.2017, so the Court is directed to expedite the trial and to conclude the trial expeditiously.
