JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 04-08-2022 Heard learned counsel for the petitioner and learned APP for the State and perused the case diary. The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 498(A), 420, 504, 509 and 494 of the Indian Penal Code. In spite of service of notice, several times, the Opposite Party No.2 is not appearing before this Court. Prosecution case is that after the death of the husband of the informant, she solemnized second marriage with the petitioner but she came to know that he is already married and stopped giving her maintenance as well as threatened to make her naked photographs viral.

It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. He

He has never solemnized the marriage with the informant and the informant has not filed any proof of marriage with the petitioner so the solemnization of marriage with the informant is false and concocted.

Learned APP appearing for the State opposed the anticipatory bail.

Considering the aforesaid submissions, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Bimlesh Kuamr, Judicial Magistrate, Ist Class, Munger/concerned Court in connection with Munger Mahila P.S. Case No. 37 of 2020, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Sunil Kumar Panwar, J) Brajesh Kumar/- U R
