The petitioner is seeking regular bail in Salkhua P.S. Case No. 49 of 2016 registered for the offence under Sections 366/ 366A/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that this petitioner is the brother of accused Daya Ram Yadav. The allegation of kidnapping of the victim girl is against said Daya Ram Yadav. The victim girl, however, appeared before the learned magistrate under Section 164 Cr.P.C., made a statement, her age has been determined as 18 years. In her statement the victim girl disclosed ill-treatment at the hands of her parents and she has been released in favour of the mother of the said Daya Ram Yadav. Learned counsel submits that so far as the present petitioner is

Patna High Court Cr.Misc. No.4815 of 2018 (2) dt.02-02-2018 2/2 concerned he has no criminal antecedent and has been falsely implicated.

Learned A.P.P. for the State is present.

Considering the facts and circumstances, let the petitioner, named above, be enlarged on bail on his furnishing bail bonds of Rs. 15,000/- (Fifteen thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. II, Saharsa in connection with Salkhua P.S. Case No. 49 of 2016, subject to the conditions as laid down under Section 437(3) Cr.P.C.
