JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 12-10-2015 Heard learned counsel for the petitioner and learned Assistant Public Prosecutor for the State. This application for grant of regular bail arises out of Dalsingsarai P.S. Case No.297 of 2015, disclosing offences under Sections 341, 323, 506 and 498A/34 of the Indian Penal Code.
The petitioner is the husband of the informant. In view of nature of accusation and the fact that the petitioner is in custody since 29.07.2015, this application is allowed.
The petitioner, abovenamed, is directed to be released on bail on furnishing bail bond of Rs.10,000/-
Patna High Court Cr.Misc. No.45984 of 2015 (3) dt.12-10-2015 2/2 (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Dalsingsarai, Samastipur, in connection with Dalsingsarai P.S. Case No.297 of 2015.
This is subject to the condition that the petitioner shall present himself before the police/Court, as the case may be, as and when required, and in the event of failure on his part to appear before the Court, on two consecutive occasions, his bail bond shall be liable to be cancelled.
Learned counsel, appearing on behalf of the petitioner and the informant, submit that they would be making efforts for resolving the dispute between the petitioner and the informant.
The Court expects better behaviour on the part of the petitioner, upon his release on bail, with the informant. It will be open to the informant to approach this Court for cancellation of bail, in case she has any grievance that petitioner has indulged in similar activities, as alleged in the present First Information Report.
