The petitioner is seeking regular bail in Arer P.S. Case No. 131/2017 (G.R. No. 850/2017) registered for the offence under Sections 414/34 of the Indian Penal Code. Learned counsel for the petitioner submits that as per allegations this petitioner was apprehended while trying to flee away after leaving the motorcycle. The allegation is that two persons were riding the motorcycles, who started fleeing away after leaving the motorcycles; one of the riders was caught by the villagers with the police force. Learned counsel submits that there is no reason to allege that the petitioner was in possession of the stolen motorcycle.

Considering the facts and circumstances, particularly that the petitioner has no criminal antecedent, let the petitioner, named above, be enlarged on bail on his furnishing bail bonds of Rs. 15,000/- (Fifteen thousand) with two sureties of the like amount each to the satisfaction of learned Munsif, Benipatti in the district of Madhubani in connection with Arer P.S. Case No. 131 / 2017 (G.R. No. 850/2017), subject to the conditions as laid down under Section 437(3) Cr.P.C. and that in case he is found involved in similar kind of offence again the Investigating Officer will have liberty to move for cancellation of bail of the petitioner.
