2. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 406 and 420 of the Indian Penal Code.
3. At the outset, learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail to the petitioner and submitted that from bare perusal of the impugned order it is apparent that proceedings under Section 82 of the Cr.P.C. has already been issued and this petitioner has been declared an absconder. It is further submitted that petitioner has also got seven criminal antecedents. In this connection, reliance is placed upon recent judgment of the
Patna High Court CR. MISC. No.49184 of 2025(2) dt.19-08-2025 2/2 Hon'ble Apex Court in the case of Prem Shankar Prasad versus the State of Bihar and Another reported in LL 2021 SC 579.
4. Considering the facts and circumstances, criminal antecedents of the petitioner, the fact that proceedings under Section 82 of the Cr.P.C. has already been issued and petitioner has already been declared an absconder and judgment of the Hon'ble Apex Court in the case of Prem Shankar Prasad (supra), the prayer for grant of anticipatory bail to the petitioner is rejected.
