According to the fardbeyan as well as statement of the victim, it was co-accused Brajesh Kumar who kidnapped the victim and so far as the petitioner is concerned, it is stated that he along with his wife also participated in the alleged kidnapping. Moreover, victim has herself stated in her statement that it was co-accused Brajesh Kumar who took her to his house and forcibly solemnized his marriage with her.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Sub divisional Judicial Magistrate, Rosera District Samastipur in Singhiya P.S. Case no. 122/2014.
