2. The petitioner seeks bail in connection with Kishanganj P.S. Case No. 14 of 2023 registered for the offence under Sections 302/34 of the Indian Penal Code.
3. As per the prosecution case, the petitioner is the husband of the victim and he is alleged to have killed the deceased after torturing her.
4. The petitioner is in custody since 29.01.2025.
5. Learned counsel for the petitioner Mr. Diwakar Kumar submits that the marriage of the petitioner and the victim was solemnized 10 years ago and the couple had four children also.
6. Learned counsel for the petitioner further submits that the children are staying with the family of the petitioner.
7. Considering the aforesaid facts, this application
Patna High Court CR. MISC. No.49070 of 2025(2) dt.11-08-2025 2/2 is allowed.
8. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge, Kishanganj/concerned Court below in connection with Kishanganj P.S. Case No. 14 of 2023.
9. As a condition of this order, the Court below, before accepting the bail bonds of the petitioner, will verify the fact that the children of the petitioner are staying with the family of the petitioner or not. If the Court below finds that the children are staying with the family of the petitioner then his bail bonds shall be accepted by the Court below and if the Court below finds that the children are not staying with the family of the petitioner then his bail bonds shall not be accepted. 10.
As a condition of this order, the petitioner, after being released on bail is directed to co-operate in the trial either by appearing personally or through his lawyer in the trial Court on each and every date fixed by the trial Court. Noncompliance of the condition will result in cancellation of the bail bonds of the petitioner.
