By order dated 05.03.2020 passed in Cr Misc No 71580 of 2019, prayer for anticipatory bail of the petitioner was allowed. Within two weeks thereafter, National Lock Down was imposed on account of COVID - 19 Pandemic. It is under such circumstances that the learned counsel submits that the petitioner could not avail the benefit of anticipatory bail granted by order dated 05.03.2020 passed in Cr Misc No 71580 of 2019. As per his instructions, no process has been issued under

Patna High Court CR. MISC. No.61429 of 2021(2) dt.03-11-2021 2/2 Sections 82, 83 of Criminal Procedure Code till date. In the aforesaid circumstances, prayer in the modification application for extension of time to avail the benefit of order dated 05.03.2020 passed in Cr Misc No 71580 of 2019, is further extended by two weeks after the Chhath Holidays.

This application is allowed and the order dated 05.02.2020 passed in Cr Misc No 71580 of 2019 stands modified to the extent indicated above.
