Petitioner, already in custody, seeks bail in connection with Yogapatti P.S. Case No.346 of 2017, registered under Sections 147, 148, 149, 452, 341, 323, 342, 302 and 506 of the Indian Penal Code.
Allegation in brief is that the deceased had eloped with the daughter of the petitioner few days back, only returned a week earlier and thereafter it is alleged that in the night the son of the informant was killed by the accused persons inside their house.
Learned counsel for the petitioner submits that there is allegation against all the family members and co-villagers that they all assaulted the deceased with lathi and fists but there is no

No.4814 of 2018(5) dt.02-04-2018 2/2 specific allegation of assault against the petitioner with lathi and his two young sons are already in custody and their bail petitions have already been rejected, the petitioner is 55 years old man, only one injury on the head proved fatal and rest other three injuries are swelling and bruise on arm and leg and the petitioner is in custody since 17.09.2017; whereas the learned counsel for the informant submits that earlier the bail petition of other two accused, sons of the petitioner has been rejected. Having considered the said facts and circumstances, the prayer of bail of the petitioner is rejected in connection with Yogapatti P.S. Case No.346 of 2017, pending in the court of learned CJM, Bettiah at West Champaran.
However, the petitioner may renew his prayer of bail after framing of charge.
