The petitioner has been made accused in Forest Case No. 9 of 2014 dated 9.2.2014 registered for the offences punishable under Sections 33, 41 and 42 of the Indian Forest Act. By filing the instant application under Articles 226 and 227 of the Constitution of India, the petitioner seeks quashing of the prosecution report submitted by the Incharge Range Forest Officer before the Court of learned Chief Judicial Magistrate, Sasaram.
Patna High Court Cr. WJC No.569 of 2014 dt.06-02-2015 2 / 2 A bare reading of the prosecution report would disclose commission of a cognizable offence.
In that view of the matter, I am not inclined to entertain the present application.
Accordingly, the application is dismissed.
