The petitioner seeks bail in connection with Barh P.S. Case No. 323 of 2014 registered for the offence punishable under Section 364(A) of the Indian Penal Code. Allegedly, Shalendar Kumar Pandey, the son of the informant was kidnapped and ransom of Rs. 50 lakhs was demanded. During investigation, the victim was recovered and in his statement, he stated the name of the petitioner and other coaccused and further the petitioner confessed his guilt also. Submission is of false implication and that the petitioner is co-villager of the informant, the informant has not paid any amount and as such, the petitioner who is suffering in

Patna High Court Cr.Misc. No.46474 of 2015 (4) dt.29-02-2016 2/2 custody since 20.05.2015, deserves sympathetical consideration, to which the learned APP opposes by submitting that in this case, the prayer of bail of similarly situated co-accused Nandu Kewat has already been rejected by another co-ordinate Bench of this Court and the petitioner has confessed his guilt also. In the facts and circumstances stated above, considering the allegation attributed against the petitioner serious in nature, at this stage, this Court is not inclined to enlarge the petitioner on bail and accordingly, his such prayer stands rejected.
