JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 28-09-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Neither petitioner was caught on the spot nor anything was recovered from conscious possession of the petitioner. It is apparent from the first information report that recovery of country made liquor was made from a pickup van whereas other articles were recovered from rice mill which does not belong to the petitioner. The owner of rice mill has already been granted privilege of bail.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief
