JUSTICE ARUN KUMAR ORAL ORDER 12-06-2017 Heard learned counsel for the petitioner and the learned APP appearing on behalf of the State. Petitioner apprehends her arrest in connection with Bithan P.S. Case No.23 of 2011, registered under Sections 147/148/149/307/341/353/171(c)/171(F)/427 of the Indian Penal Code, Section 27 of the Arms Act and Section 135(A) of the R.P. Act.
Allegation in brief is that First Information Report named accused persons along with 250 unknown persons obstructed the polling in the panchayat election, also opened firing and cast bogus vote.
Learned counsel for the petitioner submits that the petitioner was Mukhiya for the period 2012-13 and due to political reason she has falsely been implicated in this case. There is no

No.20419 of 2017 (3) dt.12-06-2017 2 / 2 specific allegation against the petitioner, the police did not find evidence during investigation and submitted final form but the court below has taken cognizance against the petitioner. Petitioner is a lady and she has got no criminal antecedent. Having considered the said facts and circumstances, in the event of arrest/surrender within four weeks from the date of receipt of this order to the concerned court, let the petitioner, named above, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Rosera, Samastipur in connection with Bithan P.S. Case No.23 of 2011, subject to the conditions as laid down under Section 438(2) Cr.P.C.
