JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 30-09-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Admittedly the informant has not seen the actual killing of the deceased nor any witness claimed to have seen the petitioner and others administering poison to the deceased. The Doctor did not find any external injury on the dead body of the deceased.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Belhar P.S. Case No. 128/2005 (G.R.No. 1142/2005) to the satisfaction of the Chief Judicial Magistrate, Banka.
