JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 28-01-2015 Heard learned counsel for the petitioners and learned counsel representing the State.

The petitioners, apprehending their arrest in connection with Gandhi Maidan P.S. Case No. 315 of 2013 registered for the offences punishable under Sections 406, 420, 467, 468, 471, 504, 506 and 120B/34 of the Indian Penal Code, seek the privilege of pre-arrest bail.

It appears that the petitioner no. 1 being Computer Operator of the Company has been shown as one of the accused with her husband. It is submitted that other Directors have been granted anticipatory bail on the basis of subsequent compromise reached between the Company and the informant. A copy of the compromise has been appended as Annexure-6. Copies of the

Patna High Court Cr.Misc. No.31072 of 2014 (2) dt.28-01-2015 some orders granting bail to the other accused persons have been annexed as Annexure-7 series, from perusal of which, it appears that others have been granted privilege of pre-arrest bail vide Cr. Misc. 14476 of 2014 by order dated 19.05.2014, Cr. Misc. No. 9676 of 2014 by order dated 02.05.2014, Cr. Misc. No. 8742 of 2014 by order dated 19.04.2014 and Cr. Misc. No. 8628 of 2014 by order dated 21.02.2014.

In the facts and circumstances as stated above, the petitioner nos. 1 and 2 namely, Rima Ghosh and Soumya Ghosh, in case of their arrest or surrender within two months from the date of receipt/production of the copy of this order, shall be released on bail on execution of bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Sri Prabal Dutta, Judicial Magistrate, 1st Class, Patna in connection with Gandhi Maidan P.S. Case No. 315 of 2013, subject to the conditions as laid down under Section 438(2) Cr. P.C.
