Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
The petitioner is apprehending her arrest in a case registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.
Liquor was recovered from the house of the petitioner in a hidden condition. Hence, it cannot be argued that the petitioner had no knowledge about the liquor. Considering the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail in connection with Fulkaha P.S.Case No.105 of 2020 pending in the court of learned 2nd Additional District and Sessions Judge-cum-Special
Patna High Court CR. MISC. No.5459 of 2021(2) dt.15-11-2021 2/2 Judge, Araria. Hence, prayer is refused.
However, in the event of surrender of the petitioner, prayer for regular bail shall be considered without being prejudiced by this order and considering the age of the petitioner, who is a female.
