JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 15-12-2021 Heard the learned counsel for the petitioners and the learned Additional Public Prosecutor for the State. The learned counsel for the petitioners is directed to remove all the defects pointed out by the office within one month.

The petitioners apprehend their arrest in connection with Shahkund P.S. Case No. 161 of 2020 registered for offence punishable under sections 341, 323, 385, 504, 506, 379, 354(B) and 34 of the Indian Penal Code.

As per allegation, the accused persons assaulted the informant in presence of the labourers and demanded ransom of

Patna High Court CR. MISC. No.5953 of 2021(2) dt.15-12-2021 2/2 Rs. 1,00,000/- (one lakh).

The learned counsel for the petitioners has submitted that there is a land dispute between the parties and a title suit No. 74/2019 is pending between them and the injury report only shows pain of the informant in her waste, chest, etc. Considering the facts and circumstances and also considering that there is a land dispute between the parties, the petitioners above named, in the event of their arrest or surrender, within four weeks from today, are directed to be released on bail on furnishing bail bonds of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-XI, Bhagalpur in connection with Shahkund P.S. Case No. 161 of 2020, subject to condition as laid down under section 438(2) Cr. P.C. Office shall ensure that all defects are removed by the petitioners within the stipulated time mentioned hereinabove, failing which, the matter shall be brought to the notice of this Court.
