JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 13-09-2023 Heard learned counsel for the petitioner and learned A.P.P appearing on behalf of the State. The petitioner is languishing in custody in a case registered for the offences punishable under Sections 435, 427, 307, 506/34 of the Indian Penal Code and Section 27 of the Arms Act.

It is alleged against the petitioner that he shot fire at the informant which hit on his neck. Earlier the accused persons came at the shop of the informant for consuming intoxicating materials and when the informant raised objection, they set the shop of the informant on fire.

Patna High Court CR. MISC. No.50419 of 2023(3) dt.13-09-2023 2/3 It is submitted by learned counsel for the petitioner that petitioner is innocent and he has falsely been implicated in this case. The petitioner and informant were on litigating term from before and in the background of this litigation, the present accusation has been levelled against the petitioner. The petitioner is alleged to have shot fire at the informant which hit on his neck but there is no injury report of the informant on record which suggests that a concocted story has been implanted against the petitioner to implicate him in a false case. The petitioner is languishing in custody since 25.04.2023.

In contra, learned A.P.P appearing on behalf of the State has vehemently opposed the prayer for bail of the petitioner.

Considering the facts aforesaid and the period under custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousands) with two sureties of the like amount
