JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 10-07-2017 Heard learned Counsel for the petitioner and learned Senior Counsel appearing on behalf of the Vigilance Department.

This application, for grant of anticipatory bail, arises out of Special Case No. 57 of 2016, arising out of Vigilance Case No. 122 of 2016, disclosing offences under Sections 13 (2) read with Section 13 (1) (e) of the Prevention of Corruption Act.

The petitioner is a Class-III employee, posted at Health Centre, Kurhni. The allegation against him is of being in acquisition of one property, worth Rs.

1,82,78,705/-, which is disproportionate to his known source of income.

Patna High Court Cr.Misc. No.25575 of 2017 (2) dt.10-07-2017 2/2 I do not find it to be fit case for grant of privilege of anticipatory bail.

This application for anticipatory bail, is hereby, dismissed.

The petitioner, Chandra Bhushan Ojha, is directed to surrender before the Court below within a period of four weeks from today and seek regular bail, if so advised. If he does so, his application for regular bail shall be considered by the learned Court below on its own merit without being prejudiced by rejection of present application for grant of anticipatory bail.
