The petitioner seeks bail in Gopalganj P.S. Case No. 258/2019, instituted for offence under Section(s) 302, 120B/34 and 506 of the Indian Penal Code.

Learned counsel for the petitioner has submitted that there is no allegation of assault against this petitioner in the written report. There is specific allegation against co-accused Chandan Dubey and Praveen Sahi of causing knife injury on the chest and back of Ashish Singh, who died on the spot. It is alleged that on the date of occurrence while informant along with his friend Ashish Singh were coming to home on motorcycle and reached near Arar More, six persons

It is alleged that Chandan Dubey and Praveen Sahi gave knife blow to Ashish Singh causing injury on his chest and back, who died on the spot. It is further alleged that about 15 days back petitioner had come to the house of deceased Ashish Singh and had threatened to kill him. Accordingly, Ashish Singh was killed on the direction of petitioner.

Petitioner is in custody since 26.05.2019.

Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gopalganj, in connection with Gopalganj P.S. Case No. 258/2019, subject to the conditions that both the bailors shall be the close relative of the petitioner. (Sanjay Priya, J) rakhi/- U T
