The petitioner is apprehending his arrest in a case registered for the offence punishable under Section, 166, 420, 468, 471 and 120(b) of the Indian Penal Code. The allegation against the petitioner and other accused persons is that they settled down all the Jalkars without any meeting and the signature of the informant.

Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. He further submits that proposal for settlement of Jalkars was sent after the resolution passed by majority of members and approved by the Block Cooperative Officer, Asthawan and on the basis of

Patna High Court CR. MISC. No.50019 of 2022(2) dt.29-11-2022 2/2 approval of Block Cooperative Officer, the Short Term Settlement was made for year 2019-20 to 2021-2022 vide letter no. 796 dated 20.08.2019. He further submits that a similarly situated co-accused has already been granted anticipatory bail by a Co-ordinate Bench of this Court passed in Cr. Misc. No. 31813 of 2020. Petitioner has clean antecedent. Learned APP appearing for the State opposed the anticipatory bail.

Considering the aforesaid submissions, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Nalanda in connection with Sare P.S. Case No. 111 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Sunil Kumar Panwar, J) Brajesh Kumar/- U T
