JUSTICE RAKESH KUMAR ORAL ORDER 04-09-2015 Heard learned counsel for the petitioner, learned AC to GA-11 as well as Sri Rajan Prasad, learned counsel, who has appeared on behalf of Respondent nos.3 and 4. This is a peculiar case, in which the petitioner has prayed for directing the Respondents to waive the interest on principal amount i.e. rent of a shop and further for directing the Respondents to give reasonable time for paying the principal amount at least in six instalments.

In the petition, there is nothing on record to suggest that the shop in question was ever settled to the petitioner. On the contrary, in the counter affidavit, it has been stated that vide letter no.99/ZP dated 05.08.2011 one Smt.Sushila Devi, widow of a

Patna High Court CWJC No.18340 of 2014 (5) dt.04-09-2015 2/2 lease holder was noticed to deposit the due rent. In view of nature of relief sought for in the writ petition as well as entity of the petitioner, the Court is of the opinion that no relief can be granted. The writ petition stands dismissed.
