2. The petitioner is apprehending his arrest in connection with Maranga P.S Case No. 22 of 2025 dated 29.01.2025 registered for the offence punishable u/s 310(4), 310(5), 111 of B.N.S. and 25(1-b)a, 26 and 37 of the Arms Act.
3. As per the prosecution case, the informant received a secret information that some unknown persons have assembled for committing crime. On which the informant along with the police personnel reached the place of occurrence. On Seeing police, five to six persons along the roadside tried to flee away, out of which three persons were apprehended and they disclosed their name as Suman Kumar Yadav, Md. Rahmat and Bijali Nadaf and these persons have disclosed the name of other
Patna High Court CR. MISC. No.48119 of 2025(2) dt.29-08-2025 2/3 co-accused as Md. Saddam, Md. Jabbar and Alok Singh who have fled away. On search, one loaded local made katta, three live cartrdges and two keypad mobile phone were recovered from the possession of the co-accused, Suman Kumar Yadav. One smart phone was recovered from the possession of the Md. Rahmat. One mobile phone was also recovered from the possession of the Bijali Nadaf.
4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. It is submitted that the name of the petitioner has transpired in this case on the confessional statement of apprehended co-accused persons namely, Suman Kumar Yadav, Md. Rahmat and Bijli Nadaf. It is further submitted that petitioner was not present at the alleged place of occurrence and no any incriminating articles have been recovered from the possession of the petitioner. It is next submitted that neither the seized arms nor the motorcycle and even no any mobile phone belongs to the petitioner. The petitioner has no criminal antecedent as stated in para 3 of the bail petition.
5. Learned A.P.P. for the State has vehemently opposed the prayer for anticipatory bail of the petitioner.
6. Considering the aforesaid facts and circumstances
Patna High Court CR. MISC. No.48119 of 2025(2) dt.29-08-2025 3/3 of the case, let the above named petitioner, in the event of his arrest/surrender within a period of six weeks from today, be enlarged on anticipatory bail on furnishing bail-bond of Rs. 20,000/- (Rupees twenty thousand) with two sureties of the like amount each to the satisfaction of the learned court concerned, Purnea in connection with Maranga P.S. Case No. 22 of 2025, subject to conditions as laid down under section 438(2) of the Code of Criminal Procedure, with further condition: (i) The petitioner is directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bonds of the petitioner are liable to be cancelled.
7. The application stands allowed.
