The petitioner seeks bail in a case under Sections 302, 120B/34 of the Indian Penal Code.

The petitioner was driving the vehicle and two persons, namely, Subodh Chaudhary and Dilip Chaudhary were the pillion riders, who made indiscriminate firing on Pawan Kumar. There is no allegation of firing against the petitioner. The prayer for bail of the petitioner was earlier rejected vide order dated 02.04.2015 passed in Cr. Misc. No. 10434/2015 with an observation that the petitioner may renew his prayer for bail after remaining nine months in jail. The petitioner is in jail since 24.12.2014. The petitioner has already remained in jail for more than nine months.

Considering the facts aforesaid, the above named

Patna High Court Cr.Misc. No.45134 of 2015 (2) dt.30-09-2015 2/2 petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sitamarhi in Bathnaha P.S.
