JUSTICE VINOD KUMAR SINHA ORAL ORDER 07-03-2018 Earlier prayer for bail of the petitioner was rejected by this Court vide order dated 18.3.2017 passed in Cr.Misc.No. 7824 of 2017 with a direction to learned trial court to expedite the trial and try to conclude it within a period of nine months and if not, petitioner was given liberty to renew his prayer for bail before the court below itself.

Submission of learned counsel for the petitioner is that period of nine months has already expired and trial has not been concluded and petitioner is in custody for the last 18 months and he has also received injury on head and there is no likelihood to conclude the trial in near future.

Heard learned APP also and perused the report from which it appears that charge has been framed in this case but not a

Patna High Court Cr.Misc. No.4620 of 2018 (4) dt.07-03-2018 2/2 single witness has been examined, which is deplorable. Having heard both sides and in the facts and circumstances, I am not inclined to grant bail to the petitioner. Hence, prayer for bail is rejected.

However, learned trial court is directed to expedite the trial on regular basis so that trial is concluded as soon as possible. At the same time, Superintendent of Police, Saharsa is directed to ensure the presence of the witnesses in court. Aforesaid directions must be complied in strict sense.

With the above observation, this application is dismissed. (Vinod Kumar Sinha, J) spal/- U
