Case i.e., Wazirganj P.S. Case No. 83 of 2009, therefore, they are being heard together and are being decided by a common order.

2. Heard the learned counsel for the petitioners and learned APP for the State.

3. The petitioners seek regular bail in connection with Wazirganj P.S. Case No. 83 of 2009 registered for the offence under Sections 307 and 353 of the Indian Penal Code and

Patna High Court CR. MISC. No.50426 of 2025(3) dt.15-10-2025 2/2 Sections 25(1-B)A, 26(ii), 27 and 35 of the Arms Act.

4. As per the prosecution case, the miscreants obstructed the road and committed robbery of a Maruti van and on seeing the police force, the miscreants started firing at police party, and in self-defense, the police also fired and one of the miscreants sustained firearm injury, and died instantly, and the other miscreants managed to escape from there. On search, one country-made pistol and cartridges were recovered from the possession of the dead miscreant.

5. This is a case of committing dacoity and firing at the police party. From the materials available on record it appears that the petitioners are involved in the crime. The petitioners are the absconders as the FIR is of the year 2009. The petitioner namely Indradeo Paswan @ Indra Paswan has two criminal antecedents and the petitioner namely Gaya Paswan has three criminal antecedents.

6. Considering the aforesaid facts and circumstances and the criminal antecedents of the petitioners, these applications for regular bail are rejected.
