2. Let the defect(s), if any, be removed within a period of four weeks from today.

3. The petitioners seek bail in connection with Nalanda P.S. Case No. 31 of 2021 registered for the offence under Section 392 of the Indian Penal Code.

4. As per the prosecution case, the petitioners have been found to be involved in a loot in which their name has transpired in the confessional statement of one Rakesh Kumar.

5. It has been submitted by the learned counsel for the petitioners that the name of the petitioners has come on the

Patna High Court CR. MISC. No.52392 of 2023(2) dt.23-08-2023 2/2 confessional statement of other co-accused Rakesh Kumar who has already been granted bail by this Court.

6. Learned APP for the State has opposed the prayer of bail of the petitioners by contending that the petitioners are named in seven more cases in which some are of Section 395 also.

7. In view of the facts and circumstances, as mentioned above, this Court is not inclined to grant bail to the petitioners/ dacoits only because of the fact that some coaccused has been granted bail by this Court.

8. Accordingly, the prayer of bail of the petitioner is rejected herewith.
