24-01-2018 Heard Sri Mahendra Thakur, learned counsel for the petitioner and learned Addl. Public Prosecutor. This is the 2nd attempt for grant of bail on behalf of the petitioner, who is in custody since 16-07-2017 in Desari P.S. Case No. 150 of 2017 registered for offence under Sections 147, 148, 149, 341, 323, 324, 307 & 332 of the Indian Penal Code and Sections 30(a), 38(1)(2), 45 of Bihar Prohibition and Excise Act, 2016, primarily on the ground that after rejection of prayer for bail of the petitioner, one another co-accused, almost in similar situation, has been granted bail by the court below itself. It has also been indicated that earlier, while the prayer for bail of petitioner was rejected on 15-09-2017, vide Cr. Misc. No. 42638 of 2017, this Court itself had observed that the prayer for bail was rejected for the moment.

No.4660 of 2018(2) dt.24-01-2018 2/2 Considering the facts & circumstances as well as observation given by this Court in earlier bail petition, let the petitioner namely Updesh Singh @ Nanhe Singh be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge 2nd cum Special Judge, Vaishali at Hajipur in connection with Desari P.S. Case No. 150 of 2017.
