JUSTICE ARUN KUMAR ORAL ORDER 04-04-2018 Heard learned Counsel for the petitioners and the State. Petitioner, already in custody since 2.9.2017, seeks bail in Raniganj PS Case No. 303 of 2017 registered under Sections 395 and 397 of the IPC.

The allegation in brief is that some unknown miscreants committed bank dacoity and looted 3,96,350 rupees cash. Learned Counsel for the petitioner submits that the FIR is against unknown and upon the confessional statement of other coaccused thirty thousand rupees and forty thousand rupees cash are said to have been recovered from the possession of the petitioners but this money is personal money of the petitioners and there is nothing on record to show that the recovered money was the looted notes from the Bank. It is further submitted that the petitioners have no criminal antecedent.

Learned Counsel for the State submits that from the possession of other co-accused bundle of notes were recovered with the wrapper of the SBI but concedes that there is no such wrapper on the notes recovered from the possession of the petitioners.

No.6623 of 2018 (4) dt.04-04-2018 Having considered the said facts and circumstances, the petitioners, namely, Anand Kumar and Suraj Kumar Mandal @ Suraj Mandal are directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) by each one of them with two sureties of the like amount each to the satisfaction of SDJM Araria in connection with Raniganj PS Case No. 303 of 2017 with the following conditions:- (i) one of the bailors shall be a close family member of the petitioners; and, (ii) The petitioners shall appear before the trial court on each date and in case of failure to appear on two consecutive dates except because of reasonable cause their bail bonds shall be liable to be cancelled.
