Petitioner, already in custody, seeks bail in connection with Rauta P. S. Case No. 135 of 2017 giving rise to Special Excise Case No. 3058 of 2017, registered under Sections 272 and 273 of the Indian Penal Code and Section 30 (a) of the Bihar Prohibition and Excise Act, 2016.

The allegation in brief is that 14.250 liters of illicit foreign liquor was recovered from the possession of the petitioner. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case and he has no concern with the seized wine. However, the petitioner is in

Patna High Court Cr.Misc. No.4982 of 2018 (2) dt.31-01-2018 2/2 custody since 14.12.2017.

Having considered the said facts and circumstances, the petitioner, Akbar Ansari @ Md. Akbar Ansari , is directed to be released on bail on furnishing bail bond of Rs. 10,000/- ( Ten thousand) with two sureties of the like amount each to the satisfaction of learned 3rd Additional Sessions Judge-cumSpecial Judge ( Excise), Purnea in connection with Rauta P.S.Case No. 135 of 2017 giving rise to Special Excise Case No. 3058 of 2017.
