2. The petitioner seeks bail in connection with Patahi P.S. Case No. 113 of 2026 instituted for the offences punishable under Sections 190, 191, 192, 303(2), 126(2), 115(2), 117(2), 109(1), 351(2), 352 and 3(5) of the BNS.
3. Allegation against the petitioner and other coaccused persons is to have assaulted the informant and his father, due to which, they sustained injury and their crops was also looted.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence and has falsely been implicated in this case due to dirty village politics. He submits that both the parties are next door neighbor and there is land dispute attributed between the parties. He further

No.50777 of 2026(2) dt.29-07-2026 2/3 submits that the main allegation is against co-accused Sunil Singh, who inflicted farsa blow on the informant's father due to which he sustained injury. He next submits that similarly situated co-accused person has been granted regular bail by a Bench of this Court in Cr. Misc. No. 50600 of 2026 vide order dated 23.07.2026. He lastly submits that petitioner has no criminal antecedent as stated in para 3 of the petition is in custody since 06.05.2026.
5. Learned APP for the State opposes the prayer for regular bail of the petitioner.
6. From perusal of the FIR and impugned order of the learned Additional Sessions Judge-XI, Motihari dated 15.06.2026, it appears that petitioner is named in the FIR. From perusal of the records, it also appears that on the basis of written report of the informant, FIR has been registered under sections 190, 191, 192, 303(2), 126(2), 115(2), 117(2), 109(1), 351(2), 352 and 3(5) of the BNS against the present petitioner and the allegation is assaulting the informant and his father and looting the crops. Petitioner has no criminal antecedent as stated in para 3 of the petition is in custody since 06.05.2026. Similarly situated co-accused persons namely Chhotu Singh @ Mukesh Kumar Singh has been granted regular bail by a Co-ordinate
Patna High Court CR. MISC. No.50777 of 2026(2) dt.29-07-2026 3/3 Bench of this Court in Cr. Misc. No. 50600 of 2026 vide order dated 23.07.2026, so I am inclined to grant regular bail to the above named petitioner.
7. Accordingly the prayer for regular bail of the petitioner is allowed. Let the petitioner above named be released on regular bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., East Champaran, Motihari in connection with Patahi P.S.
