Petitioner, already in custody, seeks bail in connection with Agamkuan P.S. Case No.312 of 2017, registered under Sections 376 and 511 of the Indian Penal Code.

Allegation in brief is that while the informant was attending the call of nature in the evening then the petitioner made an attempt of rape, when she raised alarm the petitioner escaped and police reached there.

Learned counsel for the petitioner submits that the prosecutrix is 46 years old mature lady and the petitioner is 18 years old man and in fact there is no attempt of rape and at best it can only be a case of outraging modesty, the investigation has been completed, the petitioner is in custody since 10.07.2017

Patna High Court Cr.Misc. No.10336 of 2018(2) dt.21-02-2018 2/2 and has no criminal antecedent.

Having considered the said facts and circumstances, petitioner Faizal @ Fighter is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J.-VII, Patna City in connection with Agamkuan P.S. Case No.312 of 2017, giving rise to Sessions Trial No.655 of 2017. (Arun Kumar, J) S.KUMAR/- U T
