The petitioner being the husband of the victim has renewed his prayer for bail as he is languishing in custody since 09.02.2014 in Dhamdaha P.S. Case No. 22 of 2014 (Sessions Trial No. 827 of 2014) registered for the offences punishable under Sections 498A, 304B and 328 of the Indian Penal Code.
The accusation is of killing the daughter of the informant after one and half years of marriage for nonfulfillment of the dowry demand. It is specifically alleged that on 08.02.2014 at 11.00 A.M. the petitioner took the victim from her parents' house and at 2.30 P.M. on the same day brought the dead
Patna High Court Cr.Misc. No.45845 of 2015 (3) dt.30-11-2016 2/2 body of his wife to the informant's house.
The report of learned 3rd Additional Sessions Judge, Purnea dated 8th March, 2016 reflects that all the witnesses have been examined except I.O. and the date fixed for examination of I.O. was 10.03.2016. Moreover, the trial is likely to be concluded within three months.
Considering the advance stage of the trial, this Court is not inclined to revise the earlier order. Accordingly, this application is disposed of.
If the I.O. has not been examined till date the S.P., Purnea is expected to produce the I.O. for examination expeditiously. It is expected from the learned trial court that if till date trial is not concluded then the same may be concluded expeditiously.
Let this order be transmitted to the learned trial court and the S.P., Purnea.
